1.We will be diving in and around the Bay of Islands, possibly on the wrecks of the Canterbury or Rainbow Warrior; they lie between 12 and 36 meters of water. We will concentrate most of our diving in and around the superstructure which is between 12 and 30 meters. The visibility will vary between 5 and 30 meters and the water temperature will vary between 12 and 23 deg’s C. The second dive will in most cases be a reef dive which will be between 6 and 21 meters.
2.All marine related activities, including diving, are potentially dangerous, and may require elements of skill by those undertaking the activity. You should not undertake a water based activity for which you are untrained or unprepared.
3.The Staff at Dive Op’s are trained to identify and minimise potential risk. You must follow their instruction at all times.
4.In signing the discharge of liability, you will be releasing or indemnifying Dive Op’s and our staff against any liability we incur to anyone else, resulting from your failure to follow our instructions or failure of any person under the age of 18years that is accompanying you to follow our instructions.
5.You are responsible for ensuring that persons under the age of 18, who are accompanying you, follow our instructions at all times.
6.We reserve the right to withdraw any person who, in our opinion, is likely to endanger themselves or others and we reserve the right to cancel any trip, diving, or other activity if we become concerned for any reason for your safety or that of any person. If any activity is cancelled in those circumstances we are not obliged to make any refund.
7.Under New Zealand Law it is extremely unlikely that you will be able to sue anyone if you are injured. In addition, New Zealand’s accident compensation scheme provides only limited assistance to visitors to New Zealand who are injured. We strongly recommend all visitors to New Zealand have full insurance covering any injury they may suffer, including medical treatment cover, before undertaking this activity.
8.The form you will be asked to sign does not release Dive Op’s and its staff from their obligation to act responsibly and in accordance with applicable New Zealand Laws.
9.Exclusions: To the extent permitted by law, all our liability for damage to your property, disruption to travel plans, or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.
a.Where we cancel a trip due to wind or sea conditions and we can not arrange an alternative trip date a full refund will be offered.
b.Where you cancel more than 24 hours prior to the advertised departure time a full refund will be issued, less 10%.
c.Where you cancel before 8pmNZDT the night before a 50% refund will be issued
d.Where you do not show the full amount will be charged.
e.In the case of group bookings the cancelation policy agreed at the time of booking will stand.
f.Where due to being unable to equilise, sea sickness your other health conditions you are unable to participate, or weather conditions no refund will be issued.
11.Loss of dive op’s equipment.
a.While on board and until all hire equipment is returned you are solely responsible for that equipment. Failure to return all equipment will result in you charged the replacement cost for said equipment.
